Gray warns New York drivers not to use dyed diesel on public roads

Assemblyman Scott Gray is reminding drivers, farmers and businesses that New York's restrictions on dyed diesel remain in effect on public roads, despite a federal executive order issued Oct. 5, 2026.

The federal action waives federal penalties and defers the 24.4-cent federal excise tax on dyed diesel used on roads through Dec. 31, 2026. Gray said New York still collects its own fuel taxes and prohibits dyed diesel on public roadways, with limited agricultural exceptions. He called on the state to provide similar relief.
